Review of trash collection ordinances on city agenda

Fort Scott City Commission looks to revise two ordinances during Tuesday evening's meeting at 6 p.m. in the Commission Room at City Hall, 1 E. 3rd St.

The commissioners will have the first reading of an amendment to the ordinance providing for regulation of private garbage collection service in which they will look at the following changes:

* Section 3. Permit Fee. Removal of the sentence, "The fee for new applications shall be pro-rated on a semi-annual basis."

* Section 5. Application for Permit. Change "permit" to "label" and "Police" to "Codes" as well as remove the sentence stating, "and the method and site of disposal of such garbage."

* Section 7. Vehicle Identification Plates. Change all references to "plate" to "label" as well as "Police" to "Codes".

* Section 8. Requirements for Vehicles. Add the following to the beginning of the sections, "All vehicles used for the transportation of solid waste shall be maintained in a safe, clean and sanitary condition, and shall be so constructed, maintained and operated as to prevent spillage of solid wasted therefrom. All vehicles used for transportation of solid waste which contains semi-liquid or leach ate shall be constructed of suitable material with watertight bodies. All vehicles used for the transportation of solid waste shall have covers of suitable material with fasteners designed to secure all sides of the cover to the vehicle, which shall be secured whenever the vehicle is transporting solid waste, or the entire body shall be enclosed with only loading hoppers exposed. No solid waste shall be transported in the loading hoppers." Also, changed "Police" to "Codes".

* Section 9. Disposal. Add the following, "Solid waste shall be deposited at a processing facility or disposal area complying with all requirements of the State of Kansas or any applicable law of the State where the processing facility of disposal area is located, and any applicable federal law, rule or regulation."

* Section 10. Hazardous Waste. Add the following, "The administrative authority ma classify certain wastes as hazardous waste which will require special handling and shall be disposed of only in a manner acceptable to the administrative authority and which will meet all local, state and federal regulations.

* Section 11. Penalties. Add the following, "If any person shall fail to comply with any provision of this ordinance, the administrative authority may, upon 48 hours written notice to such person, revoke and cancel such license to collect or remove solid waste within the City. In no event will any portion of the license fee be refunded to the licensee upon revocation of such license.

The commission will also be giving an amendment to the ordinance regarding littering its first reading. The amendment adds three new sections to the ordinance. Section 14 of the ordinance outlines the requirements for proper containment of solid waste to be used at "every dwelling unit and every commercial generator producing solid waste within the corporate limits of the City." Section 15 of the ordinance outlines the requirements for the collection of waste. Section 16 of the ordinance outlines the requirements for obtaining a license to transport waste.

Other items on the meeting agenda include:

* Determining the city's voting delegates to the League of Kansas Municipalities.

* Addition of Sewer Reserve Fund Account.

* Letter of support for the Lake Fort Scott sewer system.

um....wow...

okay, on to more important things. More jobs, more funding towards education, just a little more variety for the kiddies to keep busy, more programs geared towards the poor and seniors...ya know. That type of thing.

I know solid waste disposal is important, but I would love to see the Fort Scott City Commission tackle more important matters than solid waste.

Now don't tell me they do, or they have, because I wouldn't have to sit here and write about the more important matters they keep missing.

Well, 2 new city commissioners were just elected. Do these people not represent you? Unless people get out and vote in the people they will feel will represent them and then sit on them and make them do it, well, what can you expect. Plenty of apathy during the election time and after everyone comes out to complain - that will never work.

Well once again the city commissioners are adding more rules to make us citizens bow to their wishes doesnt matter it might cost us more money. Yeah we have 2 new people on the commission but do they work for us we shall see and as for your comment Eyes,maybe you better look at this town It is only about how much these good ole boys can make off of these deals yes I think we should regulate trash haulers but I agree the animal control needs to get better involved with keeping strays out of our trash to many things have been left to the wayside if it doesnt help the commissioners it don t get time and we all know it
